Field Sobriety Test

DUI Defense Attorney

A police officer has the right to pull you over if he or she has probable cause to believe you are impaired by alcohol or drugs. The police officer will then conduct a field sobriety test. The field sobriety test can consist of several different exercises, including:

There are many reasons a person might fail a field sobriety test. Pre-existing conditions, Fatigue, age, weight, nervousness, physical illness, and/or depression may impair your ability to do some of these tests. Your location can present poor conditions to conduct a field sobriety test. Were you on level ground? Were there bright or strobe lights? How was the weather? Were you facing the flashing emergency lights on the police vehicle?

Your inability to complete some of the field sobriety tests does not mean that you were unfit to drive. Undoubtedly you also did many things correctly when pulling over, stopping, and responding to the police officer. These are equally valid indicators of lack of impairment.

There are always opportunities for an experienced DUI defense lawyer to challenge the results of a field sobriety or breathalyzer test. Don't assume that because you couldn't stand on one foot, you have no defense. Never plead guilty until you've talked to a lawyer.
